This article explores the role that ‘habit’ played in discourses on crime in the 18th century, a subject which forms an important part of the history of ‘the social’. It seeks to bridge the division between ‘liberal’ positions which see crime as a product of social circumstance, and the conservative position which stresses the role of will and individual responsibility, by drawing attention to the role habit played in uniting these conceptions in the 18th century. It argues that the Lockean (...) idea that the mind was a tabula rasa, and that the character was thereby formed through impression and habit, was used as a device to explain the ways in which certain individuals rather than others happened to fall into a life of crime, a temptation to which all were susceptible. This allowed commentators to define individuals as responsible for their actions, while accepting the significance of environmental factors in their transgressions. Further, the notion that the character was formed through habit enabled reformers to promote the idea that crime could be combated through mechanisms of prevention and reformation, which both targeted the individual criminal and sought more generally to reduce the likelihood of crime. Like most topics in aesthetics, that of genre is far from simple and for the literary critic has an uninviting air. The questions which arise from its consideration fall under two heads: first, what is a genre? and second, what does it contribute to our understanding of a work of art that we can describe it as belonging to this or that genre? A clear answer to either of these questions is not readily forthcoming: the literary critic who is content (...) to be a critic here very properly hesitates where the philosopher is perhaps inclined to go further. If he does so he will find that the two primary questions about genre have many ramifications, some of which may be suggested by a quotation from René Wellek and Austin Warren's book, Theory of Literature . They ask one question about genre and then re-phrase it: but as they re-phrase their original question it is quite transformed. (shrink)

Psychiatry is rapidly adopting digital phenotyping and artificial intelligence/machine learning tools to study mental illness based on tracking participants’ locations, online activity, phone and text message usage, heart rate, sleep, physical activity, and more. Existing ethical frameworks for return of individual research results (IRRs) are inadequate to guide researchers for when, if, and how to return this unprecedented number of potentially sensitive results about each participant’s real-world behavior. To address this gap, we convened an interdisciplinary expert working group, supported by (...) a National Institute of Mental Health grant. Building on established guidelines and the emerging norm of returning results in participant-centered research, we present a novel framework specific to the ethical, legal, and social implications of returning IRRs in digital phenotyping research. Our framework offers researchers, clinicians, and Institutional Review Boards (IRBs) urgently needed guidance, and the principles developed here in the context of psychiatry will be readily adaptable to other therapeutic areas. Acting on what started as a hunch, Dr. Francis Martin has cataloged well over 20,000 distinct approaches to counseling and psychotherapy that are advertised on the webpages of licensed, practicing mental health providers. No doubt some portion of them are harmful, but the sheer volume of advertised practices and techniques, often with names deceptively similar to actual evidence-based practices, should be cause for concern among all stakeholders in the helping professions - from educators and researchers to policy makers (...) and insurance companies and, especially, consumers. Based on this significant original study, and drawing from other research and supports, Therapy Thieves describes a near-universal crisis in the field and recommends ways to rescue mental health care from itself. The crisis is caused by declining competence among counselors and psychotherapists who have failed to regulate themselves and who, therefore, deliver inadequate - if not harmful - services. In presenting a simple, yet powerful indictment of the field, Dr. Martin advocates for major reforms in several areas of mental health care, including how prospective licensees are trained, supervised and licensed, a major reworking of professional ethics, and the need to establish regulations for mental health care providers. In lieu of an abstract, here is a brief excerpt of the content:LITERARY THEORY, PHILOSOPHY OF HISTORY AND EXEGESIS XYONE FAMILIAR with the present state of biblical studies is aware that there is a significant shift on the part of many,scholars away from the historical critical method as it was practiced earlier toward methods that are based upon various theories of literature.1 Criteria for judging the aptitude of either the historical or literary method are often established on the ·basis of (...) their practical effectiveness in " yielding a meaning," particularly one that seems to serve the believing community. The difficulty with such an approach is that the philosophical principles latent in and undedying the various methods are not examined directly and are thus left to function unquestioned while the debate centers on results. The purpose of this study is modest. It is to reflect critically on a concrete work of exegesis in order to see how exegesis actually proceeds or might proceed. I a1so wish to question some of the unexpressed epistemological principles that often operate in whrut biblical scholars do. Taking rus a model those historians who have reflected philosophically on what it means to do history, I wish in a similar manner to reflect on what it means to do exegesis·. Such an undertaking, it is hoped, will advance the dialogue between systematic theology and exegesis and indicate further avenues to be explored. We have arrived at a moment when it is in the interest of both disciplines to have a clearer notion of how to assess the results of biblical study. The core problem is that of developing a theology of human communication. This will be a theology that learns from the philosophy of language and literature and yet derives its primary lessons from the unique communication that each theologian experiences in his or her personal contact with the biblical text. The work done by Paul Ricoeur in the field of the philosophy of l1 anguage and literature can provide a, point of departure in the elaboration of such a theology of communication. In addition to reflecting philosophically on many aspects of human communication, Ricoeur has expressed himself from time to time on the relation of his philosophy to biblica,l issues. Thus, in his essay, " Toward a Hermeneutic of the Idea of Revelation," 2 Ricoeur speaks of biblical hermeneutic as being " one regional hermeneutic within a general hermeneutic and a unique hermeneutic that is joined to philosophy as its organon." 3 In discussing the expression of dependence without heteronomy, at the conclusion his essay, Ricoeur goes on to say:... the experience of testimony can only provide the horizon for a specifically religious and biblical experience of revelation, without our ever being able to derive that experience from the philosophical categories of truth as manifestation and reflection as testimony.4 These statements, as we can easily recognize, touch upon a key dimension of the problem facing us as we attempt to locate the human communication of the scriptures in the context of revelation. The question is that of the presence of the unique existing within the common. Ever since Clifford Geertz urged the “blurring of genres” in the social sciences, many scholars have considered the crossing of disciplinary boundaries a healthy alternative to rigidly maintaining them. But what precisely does the metaphor of “blurring” imply? By unpacking the varieties of visual experiences that are normally grouped under this rubric, this essay seeks to provide some precision to our understanding of the implications of fuzziness. It extrapolates from the blurring caused by differential focal distances, velocities of objects in (...) the visual field, and competing perspectival vantage points to comparable effects in the intersection of different scholarly disciplines. Arguing against the holistic implications of Geertz's metaphor, as well as the even more totalizing concept of “consilience” introduced by E. O. Wilson, it suggests that blurring implies new types of complexity between or among those disciplines. (shrink)

This article examines the issues that are at stake in the current resurgence of interest in the subject of habit. We focus on the role that habit has played in conceptions of the relations between body and society, and the respects in which such conceptions have been implicated in processes of governance. We argue that habit has typically constituted a point of leverage for regulatory practices that seek to effect some realignment of the relations between different components of personhood – (...) will, character, memory and instinct, for example – in order to bring about a specific end. In reviewing its functioning in this regard across a range of modern disciplines – philosophy, psychology, sociology – we explore the tensions between its use and interpretation in different lineages: in particular, the Cartesian–Kantian/ravaisson–bergson–deleuze lineages. This special issue is motivated by the observation that conservatism plays a marginal role in contemporary philosophy even though it appears to be of considerable importance in moral, social, and political reality. One reason for this neglect is that defenders of conservatism have often refrained from articulating their arguments in a language that is acceptable to and understandable by analytically -trained philosophers. The contributions of this special issue show that conservatism can profitably be approached from the point of view of (...) analytic philosophy. Many of them are indebted to Jerry Cohen’s (2012) seminal paper on conservative value, which develops a sophisticated justification of what Oakeshott (1991) called the disposition to be conservative. Collapse is a term that has attracted much attention in social science literature in recent years, but there remain substantial areas of disagreement about how it should be understood in historical contexts. More specifically, the use of the term collapse often merely serves to dramatize long-past events, to push human actors into the background, and to mystify the past intellectually. At the same time, since human societies are complex systems, the alternative involves grasping the challenges that a holistic analysis presents, (...) taking account of the many different levels and paces at which societies function, and developing appropriate methods that help to integrate science and history. Often neglected elements in considerations of collapse are the perceptions and beliefs of a historical society and how a given society deals with change; an important facet of this, almost entirely ignored in the discussion, is the understanding of time held by the individuals and social groups affected by change; and from this perspective ‘collapse’ depends very much on perception, including the perceptions of the modern commentator. With this in mind, this article challenges simplistic notions of ‘collapse’ in an effort to encourage a more nuanced understanding of the impact and process of both social and environmental change on past human societies. Throughout history, philosophers have been fascinated by the idea of 'the will': the source of the drive that motivates human beings to act. However, there has never been a clear consensus as to what the will is and how it relates to human action. Some philosophers have taken the will to be based firmly in reason and rational choice, and some have seen it as purely self-determined. Why was it that Francis Bacon, trained for high political office, devoted himself to proposing a celebrated and sweeping reform of the natural sciences? Julian Martin's investigative study looks at Bacon's family context, his employment in Queen Elizabeth's security service and his radical critique of the relationship between the Common Law and the Monarchy, to find the key to this important question. Deeply conservative and elitist in his political views, Bacon adapted Tudor strategies of State management and bureaucracy, (...) the social anxieties and prejudices of the late-Elizabethan governing elite, and a principal intellectual resource of the English governing classes - the Common Law - into a novel vision and method for the sciences. Bacon's axiom that 'Knowledge is Power' takes on far-reaching implications in Martin's challenging argument that the reform of natural philosophy was a central part of an audacious plan to strengthen the powers of the Crown in the State. The statement that “action on behalf of justice” is a “constitutive dimension of the preaching of the Gospel” in the 1971 Synod of Bishops’ Justice in the World (JW) has been widely debated in Catholic social teaching. Popes, beginning with Paul VI, have tactfully, albeit indirectly, responded to it as they reflected on the theme of evangelization. This article traces the history of the magisterium’s reception of JW with special attention to this controversial statement. An analysis of JW in juxtaposition (...) with succeeding papal documents on evangelization reveals that Pope Francis’s culture of encounter introduces a paradigm shift while rehabilitating the original ideas of JW. In conclusion, this article sheds new light on evangelization and the Church’s social mission, wherein both charity and justice are constitutive. (shrink)

ABSTRACT It is well attested that Francis Bacon considered his History of Winds to be an exemplar, but what lessons should be taken from its example have been subject to debate. Instead of looking at this work as a mere model for the fusion of natural history and natural philosophy, it is also possible to see Bacon as trying to provide tentative solutions to outstanding questions regarding the wind, a topic that was deeply scrutinized during the early modern period. An examination of Bacon’s provisional concluding rules reveals deep correspondences with earlier works, such as José de Acosta’s Natural and Moral History of the Indies, that revised classical understandings of the wind based on experience, experiments, and accounts of travels beyond Europe. Understanding the History of Winds as a genuine attempt to solve outstanding questions about the wind uncovers its debt to earlier traditions, including those related to Renaissance natural history, and shows it’s influence in relation to specific theories of the wind beyond its call for methodological reform. Using Rawls's theory as illustration, I argue that any conception of justice which includes a commitment to equality of opportunity eventually must collide with a commitment to the family. I then contend that the link between justice and equality of opportunity cannot be severed by showing that one powerful attempt to do so founders. Borrowing from Martin Buber, I try to show that the perspective required by justice is different from and opposed to that required for intimate relations. Moreover, (...) I argue that the institution of the family provides the soil without which human intimacy withers. Finally, I try to suggest that the need for human. I?You encounters is a response to aspects of the human condition quite different from those which give rise to institutions of justice and the state. (shrink)

The theses maintained in Professor Martin's work are of two quite different types: theses about the natures and interrelations of the various kinds of knowledge and theses about the true philosophy and the false ones. The true philosophy is classical realism, the philosophy of "the Aristotelian-Aquinas tradi- tion". What is the relation between these two kinds of theses, between Mr. Martin's theory of the order and integration of knowledge, on the one hand, and his classical realism, on the (...) other? Although Mr. Martin's view on this question is not entirely clear, it seems to be the following: "Moderate realism is the most adequate metaphysical position to account for the nature and kinds of knowledge"; but "this adequacy, in itself, is not sufficient for demonstrating the truth of realism. Rather it is one sign, among others, of its truth." We shall return to this question of the relation between these two kinds of theses after considering them separately. Since my own philosophical background and orientation tend to be similar to Mr. Martin's, the following discussion may present only an insider's view, though one more positively influenced by outsiders than is Mr. Martin's. TisoA retreat program designed by the participants in the ongoing Ch'an/Zen-Catholic Dialogue explored the dialogue of religious experience and the dialogue of life, set amid the redwoods of Guerneville, California. The 28–31 January 2009 meeting was cochaired by the Rev. Heng Sure of the Berkeley Buddhist Monastery and the Institute for World Religions, Berkeley, California, and by (...) Most Rev. John C. Wester, Bishop of Salt Lake City, Utah.Sr. Mary Ann Donovan of the Jesuit School of Theology, Berkeley, led an experience of lectio divina based on John 15:1–17, Jesus's simile of the vine and the branches. Rev. Victoria Austin of the San Francisco Zen Center gave an "encouragement talk," which would typically be delivered to Zen retreatants. She referred to the Gospel passage, noting: "We don't prune the vine because it is dead, but because it has the capacity to be fruitful. We don't purify the mind to get rid of dirt, but to return to the mind's original purity, which is the source of our conscience and is the true life within us." Rev. Jan Chosen Bays of Great Vow Zen Monastery in Oregon observed that "Vows make our life energy more focused, keeping us from losing purpose and meaning. Vows prune away unnecessary things. When we ask for help with the challenge of being faithful to our vows, we call up and encounter unexpected sources of support and 'grace.' "The Ch'an Buddhist presentation focused on meditation experience, which was described as "recovering the natural state of the mind." Prof. Martin Verhoeven of the Pacific School of Religion pointed out that in meditation "we are returning to the origin, not moving forward to 'gain something.'" Linking ethical engagement with contemplation, he said, "When the mind of a meditator is motivated to act out of genuine compassion, its action is accurate and correct. Action is neither driven nor obstructed by ego or sentiment." These comments resonated with Rev. Heng Sure's presentation on the statement on the environment from the recent Gethsemane III conference "Simple and Sufficient," in which Buddhist and Christian monastics embraced an ecologically valid way of life. Urging the group to notice the connections between contemplation and ethical action, Bishop John C. Wester commented: "This [End Page 145] work embodies mercy by lifting people up; it embodies justice as it arises out of our common humanity."Because of the financial challenges that all three sponsoring institutions are facing, it was decided to conclude formal sponsorship of the Ch'an/Zen-Catholic Dialogue with this meeting. However, participants agreed to work together to reconstitute the dialogue regionally. A steering committee was designated to undertake new logistical arrangements and to draft a narrative of the previous seven years of dialogue for posting on our respective websites. Bishop Wester summarized the convictions of participants, both Buddhist and Catholic, by observing: "It is impossible not to be affected by this experience. Dialogue in this atmosphere has had an impact on my own way of ministering to others. This essay examines Pope Francis’s encyclical Laudato si’ from a Latin American perspective and its reception in this part of the world, especially in Brazil. It focuses on two aspects of Laudato si’: its dialogical approach, and the connection it makes between ecological issues and poverty. These two aspects allow us to understand Francis’s proposal of integral ecology and how the preferential option for the poor becomes central to his perspective. Yang terakhir, Paul Moses—seorang Guru Besar Jurnalistik di Brooklyn College, New York— melakukan investigasinya sendiri dan menulis suatu buku yang sangat menarik dan aktual, seperti yang boleh diharapkan dari seorang pakar komunikasi. Tolan gagal melihat tema damai dalam riwayat hidup dan tulisan-tulisan Fransiskus itu, dan dengan demikian juga tidak mengakui adanya sesuatu yang inspiratif dalam peristiwa perjumpaan itu untuk hubungan Muslim–Kristiani masa sekarang. Sebaliknya, ia agak keras menolak interpretasi sejumlah peneliti dan gerakan damai sejak akhir abad ke-20 yang melihat misi Fransiskus sebagai misi damai dan menemukan dalam Fransiskus suatu model untuk menolak kekerasan perang dan mencari pendekatan baru, khususnya dalam hal ketegangan antaragama. Kelemahan karya Tolan ini sangat tampak justru dalam perbandingan dengan karya Moses, yang tidak mendiskusikan Tolan sebab terlambat menerimanya. Buku ketiga, St. Francis and the Conversion of the Muslims, karya Frank M. Rega, amat berbeda dengan kedua studi ilmiah di atas. Dengan tidak kritis sedikit pun, Rega menggabungkan semua yang bagus-bagus dalam pelbagai versi—dari kronik-kronik paling awal sampai ke legenda- legenda yang sangat kemudian—tentang perjumpaan Fransiskus dengan Sultan itu. Tanpa membedakan pelbagai versi dan bertanya tentang latarbelakang dan tujuan masing-masing, seperti dilakukan Tolan, Rega menciptakan suatu versi gabungan yang agaknya akan disukai oleh pembaca Katolik yang saleh dan konservatif (yang memang dilayani oleh penerbit Tan Books), tetapi tidak bernilai bagi seorang peneliti yang ingin menyingkapkan maksud Fransiskus sendiri dan sumber-sumber masing-masing; dan sangat mengecewakan pembaca kritis sekarang yang mencari ilham dalam adegan ini bagi masalah-masalah dunia sekarang. Cerita legendaris Rega yang penuh triumfantalisme yang hampir-hampir yakin bahwa Sultan bertobat dan dibaptis menjelang kematiannya, tentu lebih mengganggu hubungan Kristen dan Muslim sekarang daripada membantu menemukan suatu pendekatan baru.
